TERMS OF SERVICE (EU / SLOVAKIA – SHOPIFY STORE)

These Terms of Service govern the relationship between the seller and the customer in connection with the purchase of goods through the online store Roses&Co. available at www.rosesandco.eu

These Terms are prepared in accordance with:

Directive 2011/83/EU on consumer rights,
applicable Slovak consumer protection laws (Act No. 102/2014 Coll., Act No. 250/2007 Coll.),
the Civil Code,
and applicable EU regulations.

2. CONCLUSION OF CONTRACT

2.1 Orders are placed by submitting an electronic order via the online store.

2.2 After placing an order, the Customer receives an automatic order confirmation.

2.3 A purchase contract is concluded once the Seller confirms acceptance of the order.

2.4 The Seller reserves the right to refuse or cancel an order, especially in case of:

unavailability of goods,
obvious pricing error,
suspected fraudulent activity.

3. PRICES AND PAYMENT

3.1 All prices are stated in EUR.

3.2 Prices are inclusive of VAT (adjust as applicable).

3.3 Available payment methods:

credit/debit card
bank transfer
cash on delivery (if available)

3.4 Ownership of goods remains with the Seller until full payment is received.

4. DELIVERY

4.1 Goods are delivered to the address provided by the Customer.

4.2 Delivery time is usually 3 business days, unless otherwise stated.

4.3 Shipping costs are shown during checkout.

4.4 Risk of loss or damage passes to the Customer upon delivery of the goods.

5. RIGHT OF WITHDRAWAL (14 DAYS)

5.1 Consumers have the right to withdraw from the contract within 14 days without giving any reason.

5.2 The withdrawal period starts on the day the Customer receives the goods.

5.3 The Customer must return the goods within 14 days after notifying withdrawal.

5.4 The Customer bears the direct cost of returning the goods, unless otherwise agreed.

5.5 The Seller will refund all payments within 14 days after receiving the withdrawal notice, but may withhold the refund until goods are received or proof of return is provided.

5.6 EXCEPTIONS TO WITHDRAWAL

The right of withdrawal does not apply to cases defined by EU and Slovak law, including:

custom-made or personalized goods,
sealed goods not suitable for return once unsealed (hygiene reasons),
goods which deteriorate quickly,
digital content once delivery has started with consent.

6. WARRANTIES AND COMPLAINTS

6.1 The Seller is liable for defects in accordance with applicable EU and Slovak consumer law.

6.2 The statutory warranty period is 24 months, unless stated otherwise.

6.3 Complaints can be submitted via email or postal address.

6.4 Complaints will be handled within 30 days.

6.5 The Customer may request:

repair
replacement
discount
refund (if legally applicable)

7. REFUNDS

7.1 Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed.

7.2 The Seller may withhold refund until goods are received back.

8. LIABILITY

8.1 The Seller is not responsible for misuse of products.

8.2 The Seller is not liable for failures of third-party services (including Shopify, payment providers, or carriers), to the extent permitted by law.
